Digital Millennium Copyright Act Policy
NovaPlex respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond expeditiously to claims of copyright infringement that are reported to us.
Filing a DMCA Notice
If you believe that content available on NovaPlex infringes your copyright, please submit a notification containing the following information:
- A physical or electronic signature of the copyright owner or authorized agent
- Identification of the copyrighted work claimed to have been infringed
- Identification of the material that is claimed to be infringing, with enough detail to locate it on our service
- Your contact information (address, telephone number, email)
- A statement that you have a good faith belief that use of the material is not authorized by the copyright owner
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner
Response to Valid Notices
Upon receipt of a valid DMCA notice, we will:
- Remove or disable access to the allegedly infringing material
- Notify the content provider that the material has been removed
- Terminate repeat infringers in appropriate circumstances
Counter-Notification
If you believe your content was removed in error, you may file a counter-notification containing:
- Your physical or electronic signature
- Identification of the removed material and its prior location
- A statement under penalty of perjury that removal was due to mistake or misidentification
- Your name, address, and telephone number
- Consent to the jurisdiction of the federal district court
